Selling a Morris County House
Morris County borders Essex and Passaic on its eastern side, is crossed by Interstates 80 and 287, and it is home to about 524,000 people according to the Census Bureau's 2025 estimate. The median household income was $137,326 in the latest survey, above Monmouth's $124,845 and Ocean's $89,863, and owner-occupied homes had a median value of $582,500. One resident in five was born outside the United States, and more than a quarter use a language besides English at home.
A conventional sale of a well-kept house in a desirable town can go smoothly. Where Morris County Paperwork Goes

Morris tax bills are large in dollars because home values are high, but the rate itself swings a lot from town to town. The state's effective rate, which adjusts each town's rate for its assessment ratio, is the number to compare. All 39 towns, per $100 of value:

Harding had the county's lowest effective rate in 2025, at 0.983, followed by Florham Park. Netcong was highest at 2.836, with Rockaway Borough, Wharton and Parsippany-Troy Hills behind it. On a house at the county median value, the gap between Harding and Netcong works out to nearly $11,000 a year. Foreclosure and Thursday Sheriff Sales
Morris County foreclosures follow the statewide court process, with one local calendar to keep in mind:

Auction in Morristown
Sales take place in the Commissioners' public meeting room on the fifth floor of the Administration and Records Building on Court Street, after four weeks of Friday notices in the Daily Record and a second local paper. A defendant asks for a statutory adjournment on the sheriff's form, with payment, before noon on the sale day; state law caps these at two for you, two for the lender and one by agreement.

Redemption period
The sheriff's office says the homeowner may redeem within ten days after the sale, and that only a court order can extend it.
One recent change is worth knowing. Morris County applies the Community Wealth Preservation Program, which gives eligible buyers who commit to living in the home special terms at a sheriff sale. Following an August 28, 2025 court order, the county extends the program's right of refusal only to defendants, their next of kin, and tenants; an eligible participant can put down 3.5% and has 90 days to pay the balance. A homeowner who sells while in foreclosure is protected by the Foreclosure Rescue Fraud Prevention Act: the seller may cancel the contract at any point before midnight of business day ten counted from signing, or before the sheriff sale should that come first, and the buyer may not record a deed before then. We include the required notice and form and set closing after that period ends.

Estates, Out-of-State Heirs and the Surrogate
Probate for a Morris County resident happens at the Surrogate's office on the fifth floor of 10 Court Street. If the heirs moved away years ago, that is not an obstacle: once letters are issued, the executor can sign with us remotely before a notary and the contents can stay behind.
Two taxes come up. New Jersey's inheritance tax does not apply to Class A heirs (spouses, partners, children, stepchildren, grandchildren and parents), gives siblings a $25,000 exemption, and taxes other beneficiaries at 15% or 16%; a waiver, often the L-9 form, lets the title company release the lien. Separately, a seller who lives outside New Jersey generally pays estimated income tax at closing, at 10.75% of the gain but never less than 2% of the price, though some sellers qualify for an exemption, and the deed will not be recorded without the GIT/REP form. Landlords and Tenant-Occupied Houses
Morris County rentals include two-families where the owner lives upstairs, small apartment buildings, and single-family houses leased to one household. New Jersey's Anti-Eviction Act sets out every legal ground for ending a tenancy, and a sale is not among them. There is a narrow owner-occupancy ground for buildings of three units or fewer when the buyer will live there, but we are not that kind of buyer. Certificates and Inspections
Before a one- or two-family Morris County home is sold, the local fire official must issue a smoke and carbon monoxide alarm certificate. Houses built before 1977 that use battery-only smoke alarms need sealed ten-year units. Some municipalities fold this into their own resale inspection, and each sets its own fee and lead time, so we contact the town right after you accept and handle the corrections ourselves. Every seller also completes New Jersey's flood risk disclosure, which has applied since March 20, 2024.
Costs and Attorney Review
When the deed is recorded, the seller owes the realty transfer fee, at a reduced rate for qualifying owner-occupants at least 62 years old, blind, or disabled. Since July 10, 2025, a Morris County sale of $1 million or more also carries the graduated percent fee for the seller, starting at 1% of the price and topping out at 3.5% above $3.5 million. When a real estate agent prepares a New Jersey contract, either side's attorney can cancel during a three-business-day attorney review period; a buyer backing out there or later is one reason owners turn to a cash offer.
