Selling a House in Ocean County
Ocean County takes in about 628 square miles of land, stretching from the Manasquan Inlet down to Little Egg Harbor and inland across the Pine Barrens to Plumsted. It has been growing, too: the Census Bureau counted about 637,000 residents in 2020 and estimated almost 674,000 by July 2025, a 5.7% gain that outpaced Monmouth (1.2%) and Morris (2.9%) over the same years. Nearly one resident in four is 65 or older, and that shapes the reasons houses change hands here: long-time owners moving closer to family, estates being settled, and houses that came through Sandy still being weighed against the cost of raising them.
A sale to us skips the parts of a normal listing that wear people out. We visit once, write down a figure, and if you accept, a New Jersey title company or attorney settles the deal on the day you name. Your mortgage, any liens and unpaid taxes come out of the price at that table, and you do not have to repair or empty anything beforehand.

Thirty-Three Towns, Shore to Pinelands
The county is made up of 33 municipalities. They fall loosely into three groups: the barrier island boroughs, where many houses are second homes or summer rentals; the bayside and mainland townships along the Garden State Parkway, full of post-war capes, ranches and age-restricted developments; and the western towns, where lots are bigger and a house may still rely on a private well. Those groups bring different problems to a sale. Island owners worry about flood zones, elevation and insurance. Mainland owners are more often dealing with an older parent's house, a home last remodeled decades ago, or a buyer whose financing fell apart. Out west, the well test and the septic system come up early. We have answers for each, and none of them requires you to spend money on the house first.
The Offices Behind an Ocean County Sale
The county offices a seller deals with are clustered along Washington Street and Hooper Avenue in downtown Toms River. None of them requires a visit from you when you sell to us, but here is who does what:

Property Tax Rates in All 33 Towns
Taxes in Ocean County vary more than people expect. The beach boroughs carry low rates because their assessed values are so high, while several inland towns pay close to four times as much per dollar of value. The state's effective rate is the fairer comparison between towns, because it corrects for each town's assessment ratio. Here are the 2025 figures, per $100 of value:

By that measure, Mantoloking had the lowest effective rate in the county in 2025 and South Toms River the highest. Make sure you know which side of a town line a house is on: Toms River Township and the Borough of South Toms River are separate municipalities with separate tax collectors and rates. Foreclosure and the Ocean County Sheriff
New Jersey foreclosures run through the Superior Court. If you do not file an answer, the case stays with the state's Office of Foreclosure; once it reaches judgment, the sheriff auctions the house. In Ocean County, here is how the timeline usually unfolds:

Your lender must send this by certified or registered mail. It spells out the amount needed to bring the loan current and the deadline for doing so.

An unanswered complaint moves ahead as uncontested, without a court hearing.

Free court mediation, with a housing counselor, is open to people living in a home of one to four units that they own.

The sheriff sale
Ocean County holds its auctions on Tuesday afternoons in Room 119 of the Administration Building at 101 Hooper Avenue, except on legal holidays. Each sale is advertised on four Thursdays in a row beforehand, in the Asbury Park Press and in a local paper. The law allows five adjournments of up to 30 days: two for the lender, two for you and one by agreement.

Redemption window
The sheriff's office says an owner can redeem for up to 10 days after the sale, or until the deed is delivered. Any surplus left after the debt and costs goes into the Superior Court Trust Fund, where you can claim it by motion.
The sheriff's page also notes how the county is handling the state's Community Wealth Preservation Program. While that program is under judicial review, Ocean County is not recognizing the first or second rights of refusal given to next of kin, tenants or nonprofit groups, but it does honor a defendant homeowner's own right of first refusal. If you hope to use that program, talk to a lawyer well before your auction date.
When you sell a home in foreclosure, the Foreclosure Rescue Fraud Prevention Act lets you cancel the contract up to midnight on the tenth business day after you sign it, or up to the sheriff sale if that comes first. The buyer is not allowed to take or record a deed until that time runs out. We put this notice in every foreclosure contract and set the closing date after it.

Wells, Septic and Shore Flood Rules
Two Ocean County issues catch sellers by surprise. The first is water. Under a county Board of Health ordinance first passed in 1987, no property that relies on a well for drinking water may be sold until the well has been sampled and the water analyzed. When we buy a house on a well, we arrange the test and live with whatever it shows.
The second is flooding. Sellers anywhere in New Jersey have owed buyers answers to the state's flood risk questions since March 20, 2024, including whether the property is in a mapped flood zone and whether it has flooded before. On January 20, 2026, the Department of Environmental Protection also adopted its REAL rules, which raise the standards for new building in flood-prone areas; a transition period lets some applications be reviewed under the older rules until July 20, 2027. A house that sits too low, or one that was never elevated after storm damage, can be difficult to sell to anyone relying on a mortgage, since the lender will insist on flood insurance. Estates and the Surrogate in Toms River
With so many older homeowners, a large share of Ocean County sales are estate sales. The process starts at the Surrogate's office on Washington Street in Toms River, where the will is probated or an administrator is appointed. Once letters are in hand, the executor is free to sign our contract, and nobody has to clean the house out first. Leave the furniture; we deal with it.
There has been no New Jersey estate tax on deaths since 2018. The state inheritance tax still exists, but it does not apply to transfers to a spouse or partner, children, stepchildren, grandchildren or parents. Brothers and sisters pay nothing on the first $25,000, and nieces, nephews and friends pay 15% to 16%. Since that tax is a lien on the house, the title company will ask for a waiver before closing; an L-9 form covers the common case where every heir is a Class A beneficiary. Summer Rentals and Year-Round Tenants
Ocean County has plenty of landlords, from owners of a single seasonal cottage on the island to investors holding year-round rentals on the mainland. Selling a rented house does not give you a way to end a lease. New Jersey's Anti-Eviction Act spells out the only grounds for removing a tenant, and selling the property does not appear among them, so the lease follows the house to the next owner. The narrow exception for a buyer who plans to live in a small building personally does not fit us, because we are not moving in.
That is why we buy with tenants in place. At closing, the security deposits and the interest earned on them move to us, and each tenant is told in writing, by certified or registered mail. Inspections Before Closing
Each of the 33 towns enforces the state rule requiring a smoke and carbon monoxide alarm certificate before any one- or two-family house is sold, and many have their own way of scheduling it. In Toms River, the Bureau of Fire Prevention does the inspection for $75, asks for the application at least three weeks before closing, and issues a certificate that lasts six months. Toms River no longer requires a separate municipal continued-occupancy certificate for a sale. Other towns may have different requirements, so we confirm the local rules when you accept our offer and take care of whatever repairs the inspector lists.
Costs When You Sell
Two state charges fall on sellers when the deed is recorded. The realty transfer fee is paid in brackets on every $500 of the price, with reduced rates for owner-occupants aged 62 or more, or who are blind or disabled. On homes that sell for $1 million or more, the graduated percent fee also applies for deeds recorded since July 10, 2025, starting at 1% of the whole price and rising to 3.5% above $3.5 million; that matters on parts of Long Beach Island and the northern beaches.
